How does the Delaware Workplace Safety Program work?

Delaware Workplace Safety Program is not the same as an Occupational Safety & Health (OSHA) inspection. Passing the state’s inspection program does not guarantee that your employer is up to OSHA’s code. Inspectors for the Workplace Safety Program do not come on-site to determine the level of OSHA compliance, nor any other safety regulations.

The Delaware Workplace Safety Program is designed to ascertain whether your employer’s health and safety are a priority in your employer’s business operations. A key part of the inspection is understanding how your company pays attention to identifying and mitigating workplace dangers.

The Delaware Workplace Safety Program inspection officer monitors, documents, and analyzes safety conditions at your company. These include, but are not limited to:

  • An effective health and safety program in the workplace
  • Substantial safety training for employees
  • Three years of documented workplace injury files or data
  • An understanding of the identification of potential hazardous conditions, and a commitment to limit them

OSHA regulations are federal rules that are more specific, and are not addressed by this inspector. OSHA violations could result in fines to the employer.

After the inspection, the Delaware Insurance Commissioner’s Office will provide your employer with the results and your employer will find out if they qualify for a lower insurance premium. The Delaware Workplace Safety Program works in coordination with the Delaware Compensation Rating Bureau and the Delaware Insurance Commissioner’s Office.
